I know my post on the Mississippi Personhood Amendment has been making the rounds. This is good. For the past week, I've been fighting the inclination to post on it again as I'm generally reluctant to wade into this particular topic. But I've seen some common questions/concerns come up so often that I'm just gonna take the plunge.

How will this amendment criminalize miscarriages?

The text for the amendment reads:

Be it Enacted by the People of the State of Mississippi: SECTION 1. Article III of the constitution of the state of Mississippi is hereby amended BY THE ADDITION OF A NEW SECTION TO READ: Section 33. Person defined. As used in this Article III of the state constitution, "The term 'person' or 'persons' shall include every human being from the moment of fertilization, cloning or the functional equivalent thereof." This initiative shall not require any additional revenue for implementation.


If the state legally recognizes a fertilized egg as a person, then it's obligated to investigate any loss of life. Miscarriages - referred to medically as "spontaneous abortions" - result in the loss of a fertilized egg, which would be a person.

I just don't think that the state is going to charge women for miscarriages.

Women already have been charged for miscarriages.

In South Carolina, feticide laws that were enacted to protect pregnant women from assaults by their partners have been used to charge 300 women for their miscarriages. One man has been charged under the law.

Currently, 38 states have such fetal homicide laws.

How will birth control be outlawed?

The pill - the most common form of contraceptive - has the primary mechanism of inhibiting ovulation. It also has a secondary mechanism in some pills that involves thinning the lining of the uterus which prevents fertilized eggs from attaching. As personhood would be defined from the moment of fertilization, this would mean the ejection - and death - of a legal person.

We shouldn't worry about this because it'll just go to the courts and get overturned thanks to Roe v. Wade.

Yes, the goal is undoubtedly to challenge Roe v. Wade. I don't find that a desirable outcome, especially when it can be shown that the majority are in favor of it.

I don't have a problem with the women being charged in the articles you linked to. And some birth control should be outlawed.

Okay, so I don't usually do this, but this is an issue near and dear to me and this is getting very little no attention in the mainstream media.

Mississippi is voting on November 8th on whether to pass Amendment 26, the "Personhood Amendment". This amendment would grant fertilized eggs and fetuses personhood status.

Putting aside the contentious issue of abortion, this would effectively outlaw birth control and criminalize women who have miscarriages. This is not a good thing.

Jackson Women's Health Organization is the only place women can get abortions in the entire state, and they are trying to launch a grassroots movement against this amendment. This doesn't just apply to Mississippi, though, as Personhood USA, the group that introduced this amendment, is trying to introduce identical amendments in all 50 states.

What's more, in Mississippi, this amendment is expected to pass. It even has Mississippi Democrats, including the Attorney General, Jim Hood, backing it.

The reason I'm posting this here is because I made a meager donation to the Jackson Women's Health Organization this morning, and I received a personal email back hours later - on a Sunday - thanking me and noting that I'm one of the first "outside" people to contribute.

So if you sometimes pass on political action because you figure that enough other people will do something to make a difference, make an exception on this one. My RSS reader is near silent on this amendment. I only found out about it through a feminist blog. The mainstream media is not reporting on it.

If there is ever a time to donate or send a letter in protest, this would be it.

What to do?

- Read up on it. Wake Up, Mississippi is the home of the grassroots effort to fight this amendment. Daily Kos also has a thorough story on it.

- If you can afford it, you can donate at the site's link.

- You can contact the Democratic National Committee to see why more of our representatives aren't speaking out against this.

- Like this Facebook page to help spread awareness.

She wakes with wet cheeks and sheets tangled around her hips, an ache in her chest burning low with the embers of her fading dream. She rises and uses the bathroom, rinses her hands and runs them over her face. Blearily she looks at her image, her naked body a pale shadow in the dark room, her bed and her still sleeping lover tucked deeper inside the reflection. She turns the water off and climbs back into bed.

She worries she won't sleep, broken bits of her dream crackle behind her eyes like a dying fire. She rolls onto her side, curling into the body she's shared many nights with, familiar curves soothing...


She wakes later, the sun shining, her lover silencing the alarm with a grumble. The dream is gone and Willow hides her tears in her pillow, damning the memories that left her with the feel of Tara's kisses against her lips and the melody of Tara's voice in her ears; the composure and acceptance she had learned as time went by fleeing, leaving her heart broken and bared to the dawn. The cruelest part was that she wouldn't stop the dreams, even if she could.

NYTimes, the bastion of quality reporting, reported on the gang-rape of an 11 year-old girl in Texas  that's led to charges against 18 high-school boys so far - all well and good so far, right?  Shit like this NEEDS publicity to raise awareness. 

Only problem is, they repeated - without refutation or critical commentary - the claims that the girl brought the rape on herself because of the way she was dressed.
